Action needed in the NYS Assembly to protect the 2026 elections

In this heightened atmosphere of threats against our elections and election workers, is New York ready to defend the vote count in 2026?  The short answer is no. Inaction by the NYS Assembly Election Law Committee puts our elections at risk.

Action needed in the NYS Assembly to protect the 2026 elections 

The purpose of this post is to list two-house bills that can be characterized as pro-democracy legislation that ONLY the NYS Senate has passed or advanced, but were Dead On Arrival (D.O.A.) in the Assembly. By that I mean they were not even on the Assembly Election Law Committee's 2025 AGENDA. That complete Agenda appeared on these lists on Sep. 23, 2025 at 10:17 AM (originally sent on Sep. 18, 2025 at 11:44 AM).

Three out of the five bills below are LNYV Priorities, but they are all pro-democracy bills that the Senate has passed (sometimes more than once), or advanced, which were D.O.A. in the lower house -- i.e., not even on the Assembly Election Law Committee's 2025 Agenda.

Going forward, it is essential to know who sets that Agenda. Is it the Committee Members, the Committee Chair, their staff,, the Assembly Leadership, their staff, corporate lobbyists, etc? Clearly it is NOT the bill sponsors themselves, their constituents, good government groups, or voters. Otherwise, all these bills that the Senate has moved would have at least been on the Assembly Election Law Committee's AGENDA in 2025.

Remember, for a bill to make this short list, it must be: pro-democracy, passed or advanced by the Senate, and NOT on the Assembly Election Law Committee's 2025 Agenda:

  • The Count Every Vote Act of NY (CEVA) A4307 / S417 (Dinowitz / Gianaris):

    • Passed Senate 6/6/2024 (S9677A);

    • Passed Senate 2/24/2025 (S417)

  • Democracy Preservation Act A1258 / S324 (Walker / Gianaris):

    • Passed Senate 6/3/2021 (S1126A);

    • Passed Senate 1/10/2022 (S1126B);

    • Passed Senate 3/15/2023 (S371);

    • Passed Senate 1/8/2024 (S371);

    • Passed Senate 1/13/2025 (S324)

  • Relates to Purging of Voters From Registration Lists A2635 / S4364 (Cunningham / Comrie): *

    • Passed Senate Elections Committee but NOT Assembly ELaw 5/20/2024 (S6168);

    • Advanced to Third Reading in Senate 6/4/2025 (S4364)

I hope this information will be useful when trying to convince Assembly Members, staffers, and their Leadership to support pro-democracy legislation that the Senate has already supported.
