Very Bad News

The Common Cause/ Black Institute lawsuit challenging the certification of the ExpressVote XL in New York was dismissed on Monday 5/11/26

  • The judge's decision is here.

  • The decision hinges on the idea that whether voters are using hand-marked paper ballots, where the voter's filled-in oval is interpreted by a scanner, or whether they are voting on an ExpressVote XL where the voter's intent is expressed first in text and then translated to a barcode - voters are still relying on the voting machine to interpret their ballot correctly. 

    • Thom Connolly, the Deputy Executive Director at the NY State Board of Elections, in speaking for the defense called the difference between a hand-marked paper ballot and a summary card marked by the ExpressVote XL, a "distinction without a
      difference."

    • The judge accepted that interpretation of facts. And also relied on the testing of the machine that was done for certification to say that there are no problems with the machine. 

Very Good News

We still have an opportunity to pass VIVA NY this session. 

  • That single simple piece of legislation can still preserve New Yorker's right to cast a hand-marked paper ballot.

We have a much better chance this year because

1. The NAACP is supporting the bill now

2. The Senate already has the bill on the floor calendar.

We've got to stay focused & push hard at the right times.

  • Albany is 6 weeks overdue in trying to pass a budget, and still wrangling over details

  • The legislature has massive issues to make decisions on including:

    • Changing redistricting laws

    • New York City budget crisis

    • Major pension overhaul

    • Renewable energy requirement timelines changing

If we're going to get their attention we must bring a lot of pressure.
